This Privacy Policy describes Paramount Technology Solutions LLC’s, d/b/a Acuity Cloud Solutions (“Acuity”, “we”, “us” or “our”) policies and procedures on the collection, use and disclosure of your information when you use our website, acuitycloudsolutions.com (the “Site”), and the privacy and security practices that Acuity employs when it handles Personal Information and other information
for the provision of Consulting, Project Management, Implementation, Technical Support, Maintenance or other services (collectively, the “Services”) to Acuity clients (“Client” or “Clients”).
Please read this Privacy Policy carefully. When you use the Site or the Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Privacy Policy and consent to Acuity’s collection and use of personally identifiable information (“Personal Information”) and other information as set forth herein. If you do not consent to the terms of this Privacy Policy, you should not access or use the Site or the Services in any way and should immediately exit the Site and/or discontinue use of the Services.

Website Personal Information is information that you provide when you submit a Contact Us form on our website or subscribe to our newsletter and may include but is not limited to:

- Email Address
- Phone Numbers – Landline, Cellular

Services Personal Information is personal information that is provided by the Client, resides on Client or third-party systems and environments, and is processed by Acuity on the Client’s behalf in order to perform the Services. Services Personal Information may relate to the Client’s representatives and end users, such as the Client’s employees, job applicants, former employees and retirees. Personal Information may include but is not limited to:
- First and Last Name
- Address
- Email address
- Phone Numbers – landline, cellular
- Gender
- Date of Birth
- Social Security Number
- Driver’s License information
- Union Membership
- Racial and/or Ethnic information
- Veteran Status
- User id and Password Employment
- Details which may include but is not limited to Salary History, Training History, and Personnel Reviews
- Resume details which may include but is not limited to Job History, Education History
and References - Other information that the Client collects about the Client’s representatives and end
users
Use Data
In addition to Website Personal Information and Services Personal Information, we also collect Use Data. Acuity may use cookies and third-party website browser software tools such as analysis software (which may include Google Analytics) to gather Use Data automatically from users visiting
the Site. Use data may include information such as your device type, IP address, browser type, browser version, operating system, geolocation information, the pages of the Site that you visited, the time spent on those pages, unique device IDs and other site visitation data. Some use data
including but not limited to device type, IP address, browser type, browser version, operating system, and geolocation information is available to Acuity when Client end users are logged into the systems Acuity manages or supports.
USE OF INFORMATION
The Personal Information we collect is used for various purposes in connection with our business, including but not limited to the following:
The Website Personal Information is used to:
- Communicate with you, including responding to your inquiries and requests, to notify you about important changes to the Site, and to provide you with information related to the services we provide or that we otherwise believe will be of interest to you;
- Send you email communications if you have subscribed to that service;
- Identify products and services in which you might be interested; and
- Enforce our Site policies.
The Services Personal Information is used to:
- Provide the Services to the Client including providing customer service and support, and responding to your inquiries and requests;
- Communicate with you, including to notify you about important changes to the Services, and to provide you with information related to the Services or that we otherwise believe will be of interest to you;
- Customize, measure, manage and improve our services;
- Identify products and services in which you might be interested; and
- Prevent potentially prohibited or illegal activities, and enforce our policies.
By choosing to use the Site or the Services, you consent to Acuity’s use of your Personal Information and/or the use of the Personal Information of your representatives and end users for the purposes set forth herein.
Acuity uses Use Data in order to monitor use of the Site and the Services, for the Site and the Services’ technical administration, and to improve the Site and the Services. Acuity also uses Use Data collected from the Site to conduct tracking and analytics including customer demographics, for marketing and advertising purposes, and to help us understand how people use the Site.
E-mail Correspondence
If you provide us with your email address, you authorize us to send you regular emails unless and until you request to unsubscribe from such emails. We will use your email address to respond to your inquiries, requests or questions, to provide information about changes to the Site, and to
provide other information that we believe may be of interest to you including information about our services. Each email we send contains an easy, automated way for you to unsubscribe from further emails from us. Select the “unsubscribe” link in the footer of an email from us and follow the directions to communicate your preferences to us.

SHARING OF INFORMATION
Service Providers
We engage certain trusted third parties to perform functions and provide services to us, including, without limitation, hosting and maintenance, customer relations, database storage and management, data analysis, payment processing, and legal, accounting, and/or marketing services. We may share your Personal Information or Use Data with these third parties, but only to the extent necessary to perform these functions and provide such services.
Other Third Parties
We also may share, disclose, or transfer your Website Personal Data with third parties as follows: (a) to government agencies, advisors and other third parties, where necessary and appropriate, in order to comply with applicable laws, the service of legal process, or if we reasonably believe that such action is necessary to (i) comply with the law requiring such disclosure, (ii) protect Acuity’s rights or property, (iii) prevent a crime or protect national security or (iv) protect the personal safety of the users or the public; (b) if we believe your actions violate our policies; or (c) in connection with a financing or a sale, acquisition or merger of our business or our business assets. We may also share with others non-personally identifiable information, or aggregated or anonymized information that does not directly identify you.
Services Personal Information regarding and/or received from a Client is also subject to any specific agreement with, or notice to, the Client. Services Personal Information and Use Data may be shared with Oracle or other software vendors to the extent necessary to troubleshoot software issues.
EU RESIDENTS – PRIVACY SHIELD
Acuity complies with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework regarding the collection, use, and retention of personal information from European Union member countries (and Iceland, Liechtenstein, and Norway) and Switzerland transferred to the United States pursuant to Privacy Shield. Personal Information transferred to the U.S. in reliance on the respective Privacy Shield framework is subject to Acuity’s Privacy Shield Policy. Acuity’s Privacy Shield Policy does not apply to Personal Data transferred under Standard Contractual Clauses or any approved derogation from the EU Directive.
Unauthorized Use
Unauthorized attempts to use our Site or Services in a way that violates our policies, to utilize the Site or Services for other than their intended purposes, or to defeat or circumvent the Site’s or Services’ security features are strictly prohibited. We do not intend for the Site or Services to be used by children under the age of 13, nor do we seek to collect information about children under the age of 13. If you are under the age of 13, please do not provide us with any information and promptly exit the Site.
Third Party Sites or Apps
The Site may contain links to external websites, plug-ins or applications. Please note that this Privacy Policy applies only to the Site and our Services, and not to third party websites or applications to which the Site or Services link. Acuity is not responsible for the practices and policies (including privacy policies) of third parties and, therefore, you should review the privacy practices and policies of such third parties prior to providing your Personal Information in connection with such websites or applications.

Acuity uses reasonable care to protect the privacy and security of Personal Information and to employ appropriate industry standards. Where appropriate, we employ firewalls, encryption technology, and user authentication systems to control access to systems and data.
Unfortunately, no Internet transmission is ever completely secure, and we cannot guarantee that unauthorized access, hacking, data loss or other breaches will never occur. WE EXPRESSLY DISCLAIM ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO ANY BREACHES OF SECURITY, DAMAGE TO YOUR DEVICE, OR ANY LOSS OR UNAUTHORIZED USE OF YOUR PERSONAL INFORMATION OR OTHER DATA.
Privacy Policy Updates
Acuity may amend, update or modify the terms of this Privacy Policy at any time, by posting an amended Privacy Policy on Acuity’s website. If there is a significant change to the Privacy Policy, Acuity will email the amended Privacy Policy to customers for whom it has a valid email address. If
you do not consent to the terms of this Privacy Policy, as amended, you should not access or use the Site in any way. By continuing to access or use the Site or the Services after those changes become effective, you agree to be bound by the amended Privacy Policy.
